What happens if you fail diversion on your DUII charge?Think of diversion as a contract between you and the court. If you successfully complete diversion, your charge will be dismissed. No conviction. No additional penalties (fines, suspension, jail). If you fail diversion, you will be convicted of the DUII charge and sentenced without a trial. You will be ordered to do all of your diversions obligations over again. You will be sentenced to at least 48 hours jail or 80 hours of community service. You will face at least $1000 in additional fines. Yor license will be suspended for at least one year. Diversion termination and sentencing usually happens at a "show cause" hearing. It is vitally important that you take your obligations seriously and successfuly complete the program. |
