Oregon City DUII and Clackamas County Court Information

 


 

I just got arrested for an DUII charge in Clackamas County.  What happens now?

 

For general information on Oregon DUI arrests please consult the main page of the Oregon DUII Guide and the DUII Diversion Guide

 

If you were arrested in Clackamas County, Oregon you were either given a citation to appear in court or booked into the Clackamas County Jail.  If you were booked into jail you most likely were given a release agreement directing you to appear in court at some date in the future.  If you were arrested for a felony DUII or other serious charge you may be held in custody at least through your first court appearance (and perhaps longer). 

 

If you were arrested in the City of Gladstone, you likely were directed to appear in Gladstone Municipal Court (525 Portland Avenue in Gladstone, Oregon)

 

DUII arrests in West Linn often are prosecuted in West Linn Municipal Court (22500 Salamo Road in West Linn, Oregon).

 

Canby DUII's are usually prosecuted in Canby Municipal Court (1175 NW 3rd Avenue in Canby, Oregon).

You must attend your court appearance or a bench warrant will be issued for your arrest.  In Clackamas County, if you hire an attorney before your initial court appearance (arraignment), you may be able to absent yourself from this appearance if your most serious charge is a misdemeanor.  Speak to an attorney for more information.

Where am I supposed to appear for court?

 

Read your paperwork.  Either your citation or your release agreement will tell you where to appear for your first court date.  Most Clackamas County DUII arraignments are held at the Clackamas County Circuit Court (807 Main Street in Oregon City, Oregon) unless you're cited into one of the municipal courts listed above.  These Circuit Court appearances are typically held at 3:00 p.m. or 3:30 p.m. about 30 days after your arrest date.

 

Show up on time.  Check in at the information window to find out which courtroom is handling your case.

Will all my court appearances be held in this building?

Yes.  All Clackamas County Circuit Court appearances are held in the Clackamas County Courthouse.  All municipal court appearances are held in the same municipal court as the first appearance.

Are there any sentencing options that are unique to Clackamas County?

Generally not.  Clackamas County does not offer a work in lieu of jail option; rarely offers community service; and almost never allows work release for DUII sentences.   Gladstone, Canby, and West Linn Municipal Courts are similar.  All most all Clackamas County DUII convictions will result in a sentence of formal probation.

Keep in mind that DUII is a state crime.  While each court treats these charges in their own way, the DUII statutes and mandatory penalties such as license suspensions are the same statewide.
